Content Highlights
“Most ethics guides march through the ethics rules one by one in numerical order. Unfortunately for lawyers looking for guidance, that approach puts the cart before the horse—because they must know which rule is likely to govern their specific conduct in the circumstances they face.” Tom Spahn, author
The new An Ethics Guide for Virginia Lawyers turns the typical approach to ethics rules on its head. Hoping to better help lawyers locate the pertinent ethics rule and then understand it, the book abandons the rule-by-rule walkthrough. Instead, the authors have followed the general lifespan of a lawyer’s practice, and then specifically the lifespan of a lawyer’s representation of his or her client.
This practical approach results in a deep but easy to reference guide to the Virginia Rules of Professional Conduct, as well as their interpretation and application in legal ethics opinions (LEOs) and unauthorized practice of law cases. The law of other jurisdictions, as well as the ABA Model Rules, are considered alongside these Virginia laws to clarify understanding and to flag issues for multi-jurisdiction practice.
