Courts and federal and state regulators have different and sometimes contradictory interpretations of what Title IX of the Education Amendments of 1972 requires with respect to sexual harassment as a form of sex discrimination. There is a circuit split with respect to how colleges and universities must handle grievance procedures under Title IX. For example, some federal appellate courts have held that colleges and universities must provide for cross-examination during a grievance procedure to resolve sexual harassment allegations, while others have not. The U.S. Department of Education recently promulgated regulations under Title IX in May 2020, but those regulations may be rescinded or revised. In this state of flux, this seminar covers cutting-edge issues in Title IX litigation and also the regulatory landscape that governs day-to-day college sexual harassment proceedings.
This seminar provides attorneys with insight into the intricate legal framework that governs how colleges and universities resolve allegations of sexual misconduct against their students. It delivers practical advice to attorneys in all roles in this unique legal setting—those advising accused students, complainants, and witnesses, as well as those representing colleges and universities. It explores considerations unique to a setting that is neither criminal nor civil in nature. And it surveys the rapidly developing case law and regulations defining the obligations of schools and the rights of complainants and respondents.
