The allure of performing a great cross-examination convinced many of us to become lawyers: latter-day Perry Masons, skillfully leading the hostile witness into damaging admissions, if not outright confessions from the witness box. In reality, it rarely works out so well. Too often the cross-examination is perfunctory, without a plan or theory, and fails to advance the examiner’s case, or worse, helps the other side.
Yes, cross-examination is partly art, but there is enough science behind it that anyone can improve by studying the rules and formulating a plan. Our expert faculty will lay those rules out clearly during this seminar. Using demonstrations of both ineffective and effective cross-examinations, they will teach you how to avoid common pitfalls and follow best practices. Significant time will be spent on impeachment and the intersection between cross and impeachment.

The Honorable Brendan U. Dunning is a Juvenile and Domestic Relations Court Judge in the 10th Circuit of Virginia. Previously, he served as an Assistant Commonwealth’s Attorney and Regional Drug Prosecutor in Halifax County. After prosecuting, he worked in private practice concentrating on civil litigation and criminal defense. He also served as the Commissioner of Accounts of Halifax County.
Michael HuYoung, Barnes & Diehl, PC / Richmond
Michael HuYoung is a shareholder at Barnes and Diehl, PC. His areas of practice are Criminal Defense and Family Law. He began his law practice in 1982 after graduating from the University of Richmond School of Law. He obtained his undergraduate degree with distinction from the University of Virginia. He is admitted to the United States Supreme Court, United States Court of Appeals (4th Circuit), United States District Court (Eastern and Western Districts of Virginia), Virginia Supreme Court, and Virginia Court of Appeals and practices in the Circuit, General District, and Juvenile and Domestic Relations District Courts throughout the Commonwealth. He has served as a Substitute Judge since 2000 appointed by the 14th Judicial Circuit. Appointed by the Governor, Mr. HuYoung has served on the Criminal Justice Services Board and currently serves on the Forensic Sciences Board for the Commonwealth of Virginia.
Mr. HuYoung is inducted into the Virginia Lawyers Hall of Fame sponsored by Virginia Lawyers Weekly, is listed in the Best Lawyers®, and was its “Lawyer of the Year in White Collar Criminal Defense” in 2012. He is a Senior Fellow of the Litigation Counsel of America, an invitation only trial lawyer honorary society. In 2010, he was selected as a “Leader in the Law” by Virginia Lawyers Weekly. He is a Virginia Super Lawyer® and a Virginia Legal Elite. He is also AV® rated by Martindale-Hubbell. Mr. HuYoung was a former Adjunct Professor at the University of Richmond Law School and coached its Trial Advocacy Board’s Mock Trial Competition teams as well as its Moot Court teams. He is a frequent lecturer at continuing legal education seminars for attorneys and judges.
Mr. HuYoung currently serves on the Virginia State Bar’s Standing Committee on Legal Ethics. He is a member of the Virginia State Bar’s Diversity Conference after serving as a Former Chair, Past Board Member, and a Founder of the Conference. In 2019, Mr. HuYoung was awarded the Clarence M. Dunnaville, Jr. Award, named after the notable civil rights lawyer, by the Virginia State Bar for his work in promoting diversity and inclusion in the legal profession. He also has served on the Virginia State Bar’s Executive Committee and Bar Council. He is a Fellow of the Virginia Law Foundation and sits on its Board. He is a member of the Virginia Bar Association and serves on its Governance Committee after serving on its Board and as a former Chair of its Criminal Law Section. He is also a member of the Virginia Trial Lawyers Association, a former Board member, and chaired its Criminal Law Section. He serves on the Virginia Criminal Justice Conference after being a Past Chair and a Founder of the Conference. He is also a member and Director of the Asian Pacific American Bar Association of Virginia and was the recipient of its Award of Excellence in 2008.
Hon. Kimberley S. White, Court of Appeals of Virginia / Richmond
Judge Kimberley S. White graduated from Mary Washington College (now University of Mary Washington), in Fredericksburg, Virginia, in 1985 where she received degrees in English (Literature Concentration) and American Studies. She went on to receive her Juris Doctor in 1988 from Walter F. George School of Law of Mercer University, Macon, Georgia. Judge White practiced law at Woods, Rogers, PLC (formerly Woods, Rogers & Hazlegrove) in Danville, Virginia, as an Associate and as a Principal. She served as Commonwealth’s Attorney for the County of Halifax, Virginia, from January 2004–2012. Earlier in her career she was an Assistant Public Defender and a Special Assistant United States Attorney. Judge White was appointed by the Governor as a Judge for the Tenth Judicial Circuit of the Commonwealth of Virginia in August 2012 and was elected by the General Assembly in January 2013. In June 2017, Judge White was elected by the General Assembly to the Court of Appeals of Virginia.
Active in the Virginia State Bar, Judge White chaired the Committee on Lawyer Discipline, which oversees the Bar’s disciplinary system, for four years. She has lectured and taught on ethics, trial advocacy, and HIPAA to attorneys throughout the country. Judge White also has taught classes on gang prosecutions and child pornography detection to law enforcement audiences. She was honored by Virginia Lawyer Media by being named to the 2011 Class of the Influential Women of Virginia. The year prior she and another elected prosecutor were the first-ever sitting Commonwealth’s Attorneys to be elected as Fellows of the Virginia Law Foundation.
