This program is a replay and expansion of the Annual Employment Law Update ethics session entitled “Ethical Challenges in Communicating with Represented Parties,” originally presented in May 2023.
In this two-hour seminar with hypotheticals, experienced employment law attorneys John E. Davidson and Edward Lee Isler present the one-hour session from the Annual Employment Law Update ethics session again. Then they present an additional hour covering the ethical dilemmas that arise in employment litigation in trying to comply with Rule 4.2 of the Virginia Rules of Professional Conduct, which prohibits communication with a represented person. Issues include contacting former employees of the defendant employer, concerns that settlement offers are not being conveyed, and much more.
