In this program, a panel of experienced attorneys and a skilled mediator/judge address how attorneys can assess whether there is a realistic chance to settle a case. The course topics include methods for determining the real settlement value of a case and how to manage client expectations while also advocating to get the best possible outcome for the client. The course touches upon mathematical and statistical analysis of both the likely possible outcomes as well as the client’s chances of success at trial and how to use this analysis to build a successful negotiation strategy.
Attendees hear the dos, don’ts, and unwritten rules of negotiations to avoid having them go off the rails. This program is designed for both new and experienced attorneys and presents alternatives to linear negotiations, such as the “Ballpark” Method and the “Closing the Net” Method of negotiations.
The course also presents the topic of negotiations from the perspective of a judge/mediator with many years of experience. The judge imparts his wisdom gained from presiding over cases and mediating hundreds of cases and will include a discussion on which negotiation methods and strategies are the most and least effective.
Finally, the course includes an in-depth discussion of ethical considerations in negotiations and teaches attorneys how to avoid running afoul of their ethical obligations.
Hon. Thomas D. Horne, 20th Judicial Circuit Court (retired), McCammon Group / Leesburg
The Honorable Thomas D. Horne retired as a Judge of the Circuit Court for the 20th Judicial Circuit in 2013. Following his retirement, he has continued to sit as a judge by designation in a variety of jurisdictions. In addition, he joined The McCammon Group, a leading provider of mediation, arbitration, judge pro tempore, and special master services in the mid-Atlantic region.
Judge Horne served as a circuit court judge for more than thirty years of distinguished service to the Commonwealth, including serving four terms as Chief Judge. He is a Past President of the Loudoun County Bar Association, a founding member of the Loudoun County Legal Aid Society, and the first full time Commonwealth’s Attorney for Loudoun County.
Jude Horne is the recipient of the Harry L. Carrico Outstanding Career Service Award and has been a committee member and editorial writer for the Circuit Court Judge’s Benchbook for more than twenty-seven years, having served as its chairman for much of that time. He is a veteran of the United States Marine Corps for which he was awarded the Navy Commendation Medal for his service in Vietnam and a Certificate of Commendation with respect to his service as a military judge.
Judge Horne is a past member of the faculty of the Professionalism Course and has participated in a variety of CLE programs.

James P. Magner, Magner Law, PLLC / Leesburg
Jim Magner has served as the principal shareholder and managing attorney for Magner Law, PC for ten years. He has extensive litigation experience in a wide variety of civil matters, including construction and contract law, business law, estates and trusts, elder law, real estate law, personal injury, and intellectual property. He has practiced before the state and federal courts as well as several administrative agencies and has experience in both arbitration and mediation.
Mr. Magner graduated from Virginia Tech in 1992 and earned his law degree from George Mason University School of Law in 2000, where he served on the moot court board. He clerked in the Fairfax County Circuit Court before taking a position as the Clerk of the Court for the U.S. Coast Guard Court of Criminal Appeals.
Mr. Magner entered private practice in 2002 and has been actively litigating ever since. He has served as a guardian ad litem for incapacitated adults, as a special commissioner of sale, and as a special justice in the 20th judicial circuit.
Mr. Magner takes time to help young, up-and-coming attorneys as well, having served as both a moot court judge for his alma mater and as a guest speaker and lecturer for the Virginia Tech Pre Law-Society.
John Altmiller, Altmiller, Melnick, DeMers, Steele & Rosati, PLC / Tysons
John C. Altmiller has been a shareholder in the firm since 2008. His practice is concentrated in real estate, real estate litigation, civil litigation, business law, landlord-tenant, collections, and contract law. He has tried cases in state, federal, and bankruptcy courts, and has numerous reported cases. He has been lead counsel in over sixty circuit court trials, and he has also represented parties in proceedings before regulatory boards and associations.
Mr. Altmiller graduated from Villanova University in 1988 and received his law degree from George Mason University in 1992. He is the former co-chairman of the Real Estate Section of the Fairfax County Bar Association. He has been a speaker at many continuing education seminars throughout Virginia in the areas of real estate and litigation.
Lindsay Hendrix, Meyer & Bowden, PLLC / Leesburg and Stafford
Lindsay Hendrix has been practicing law for 22 years. In her early career, Ms. Hendrix was a prosecutor and then a criminal defense attorney, which she credits for teaching her strong litigation skills.

Ms. Hendrix graduated Summa Cum Laude from the University of Kentucky with a BS in Journalism in 1997 and With Honors with a JD in 2002 from the George Washington University Law School. Ms. Hendrix is a member of the Virginia State Bar and has been selected to SuperLawyers Rising Stars three times and SuperLawyers seven times. She has also served as mentor for the Leadership in the Law Camp program in Loudoun County.
