Estate tax planning is entering a new era. Attorneys must be prepared to address not only federal estate tax issues but also the increasingly complex and often overlooked state-level estate and inheritance taxes. These taxes vary widely by jurisdiction and can significantly impact clients’ estates.
By understanding the nuances of state estate tax regimes, attorneys can better serve their clients through proactive planning strategies. This includes mitigating exposure to state taxes, navigating constitutional challenges, and integrating international considerations for clients with cross-border assets or beneficiaries.
Further, estate plans can be strengthened by incorporating flexible tools and techniques that address multi-jurisdictional concerns and anticipate future legislative changes.
