Attorneys often counsel estate planning clients on the creditor protection provided by a spendthrift trust. But defending those trusts from an active creditor claim—arguing that the claim cannot be satisfied from assets otherwise available for the debtor’s benefit—requires understanding the law, how it has developed over time, and how courts have applied it. This course will outline the development of spendthrift trust law, review the current state of the law in Virginia, and explore case law from Virginia, other states, and the federal courts.
The possibility of divorce is one of the main reasons clients choose to leave assets to their kids in trust. This course will specifically review case law involving claims against trust assets in divorce. It will also review valuable lessons for trusts and estates attorneys, family law attorneys, and trustees.
With the exception of Medicaid trusts or self-settled asset protection trusts, this course will discuss how to incorporate spendthrift trust protections into trusts while achieving clients’ other goals.

Full refunds or transfers are available up to two days after a webcast in the unlikely event that you experience technical difficulties.
MCLE Credit Caveat: The MCLE Board measures credits by the time you spend in attendance. If you enter a seminar late or leave it early, or both, you must reflect those adjustments accurately in the credits you report on your credit reporting form. A code will be given at the end of the seminar, which must be written on your MCLE form.
