Lunch Presentation: City of Lynchburg—Blackwater CSO Tunnel
Timothy A. Mitchell, Kevin Kilby, Nathan Scalla
The Blackwater CSO Tunnel Project, called LYHBeyond, is a major investment in the protection of Lynchburg’s cherished waterways and the largest capital improvement project in the City of Lynchburg’s history. It will be the city’s most impactful project to date to protect our streams and the James River from combined sewer overflows (CSO).
The Blackwater CSO Tunnel is designed as an underground tunnel nearly one mile in length and 12 feet in diameter, situated approximately 70 to 120 feet beneath the Blackwater Creek. It will collect and store up to 4.7 million gallons of combined sewage and stormwater during heavy rainfall, keeping wastewater from overflowing into Lynchburg’s waterways.
This presentation provides an overview of Lynchburg’s CSO Program history and discusses the planning, funding, permitting, risk management, and construction associated with this capstone project.
Utilizing the Public-Private Partnership (P3) Delivery Method in Virginia
L. Daniel Bidwell, John C. Wheatley
This presentation provides an in-depth overview of Virginia’s Public-Private Partnership (P3) framework, covering its statutory foundations, procurement processes, and risk allocation strategies. Using case studies like the I-495 HOT Lanes, it highlights practical insights into structuring, negotiating, and modifying P3 agreements while addressing key legal and financial considerations for infrastructure development.
Restrictive Covenants in Virginia—An Update on the Law and Practice Tips for Drafting Enforceable Covenants
David E. Constine, III, Ashley Passero
The presentation focuses on changes in the law of covenants not to compete and non-solicitation agreements, including statutory and common law changes. The speakers also discuss practice pointers for avoiding traps for the unwary in drafting.
DEI and Title VI in 2025
Henry L. Chambers, Jr., Eric Crusius
The session discusses how to navigate the brave new world of DEI in public contracting. It considers the current law on contracting and the new administration’s interpretations of the law, including executive orders and DOJ guidance.
The Effects of Copyright and Trademark Law on the Construction Industry
Andrew P. Connors, Jake L. Bryant
This presentation discusses the Copyright Act’s unique protections for “architectural works,” as well as the implications of copyright and trademark law on engineering/design ownership, licensing, and project development across the broader construction industry.
Corporate Depositions
James Neale, Bryan Slaughter
Like the American League’s designated hitter rule, corporate depositions under Rule 30(b)(6) and Virginia’s Rule 4:5(b)(6) provide unique opportunities and risks. Your case may turn on the testimony that results. This session covers tactics, strategy, pitfalls, and mechanics. The speakers cover both the plaintiff’s and defendant’s view and offer perspectives useful in taking and defending corporate depositions, including how to best prepare notices, select and prepare witnesses, obtain the testimony you need for trial, and enforce the rules in the event of non-compliance.
