Cashing In (or Not) on the 2020 Changes to the Virginia Wage Payment Act

When the Virginia General Assembly significantly reshaped the state’s employment law landscape in 2020, one of the most impactful developments was the enactment of the Virginia Wage Payment Act (VWPA). These materials provide an overview of that Act, along with the related Virginia Overtime Wage Act (VOWA)—both introduced in 2020—and their subsequent amendments. The discussion will also examine how these substantive changes have affected both employers and employees, drawing on emerging case law as well as the presenters’ perspectives. Notably, this presentation incorporates viewpoints from both sides of the bar, offering insight from those who primarily represent employees and those who typically represent employers.

Recent Developments in the FLSA White-Collar Exemption Arena

The past two years have seen significant activity relating to the so-called “white-collar” exemptions—the federal minimum wage and overtime exemptions for executive, administrative, professional, computer, and outside sales employees—under the Fair Labor Standards Act of 1938, as amended (the “FLSA”)2. In addition to rulemaking by the United States Department of Labor (“DOL”), the courts have been busy addressing important issues involving these exemptions, ranging from job duties to compensation to the very authority of DOL itself to regulate in this space. This presentation begins with a review of the background principles necessary for a working understanding of these exemptions and then proceeds to discuss the key recent developments.
