With the current state of the statutory and case law in DUI cases, success in these matters is often about negotiating and understanding the technical challenges based upon the specific facts of each case. This program is designed to equip defense attorneys, Commonwealth’s attorneys, and judges with the knowledge and skills to issue spot.

Cancellation Policy: Cancellation/transfer requests will be honored until 5:00 p.m. the day preceding the seminar. You will, however, be charged $90 if you cancel or transfer your registration to a different seminar after the link to the materials has been e-mailed by Virginia CLE®.
Full refunds or transfers are available up to two days after a webcast in the unlikely event that you experience technical difficulties.

MCLE Credit Caveat: The MCLE Board measures credits by the time you spend in attendance. If you enter a seminar late or leave it early, or both, you must reflect those adjustments accurately in the credits you report on your credit reporting form. A code will be given at the end of the seminar, which must be written on your MCLE form.

10:15 | Science of Breath Testing and New Technology This session will present the principles of electrochemical and infrared breath testing on Virginia’s current Intox EC/IR II and the probable new instrument—the Drager Alcotest 9510 (the Virginia Department of Forensic Science is in the final stages of finalizing the contract for the Draeger Alcotest 9510). It will also explore the strengths and weaknesses of trying to determine blood alcohol content through a breath sample and legal strategies that result. |
