In today’s world, there are many types of families. Unique family structures mean that a simple will is not going to work for most families—especially for blended families, second marriages, and beneficiaries with unique needs or risks. It is important to know how to structure estate planning documents to balance competing interests between spouses and children, plan effectively for minors through guardianships and tailored trust provisions, and preserve eligibility for public benefits using special needs trusts. Attorneys need to know how to protect inheritances from divorce and creditors, as well as the strategic use—and potential pitfalls—of incentive and discretionary trusts to address behavioral concerns.
