When a plaintiff has a disability or injury, is a minor, or is otherwise vulnerable, it is essential to understand how to assess a plaintiff’s needs, including whether they have a disability, receive or are applying for means-tested government benefits, or are a minor or over the age of 65.
Mr. Tiefenback will discuss Pooled First-Party Special Needs Trusts and Settlement Preservation Trusts, as well compare pooled trusts and standalone trusts. In addition, he will present an overview of traditional Medicaid versus Medicaid expansion, as well as Supplemental Security Income (SSI) and Social Security Disability Insurance (SSDI), and what steps need to be taken to protect these essential benefits. He will review Medicare Set-Asides (MSAs) and structured settlements, and how they can be coordinated with a trust. Finally, he will examine how to assist with the court order or settlement agreement, as well as contractual documents related to the MSA or structured settlement.

Ben Tiefenback, Esq., is Counsel and Director of Client Services at Commonwealth Community Trust. Prior to joining CCT, Mr. Tiefenback was a trust and estate attorney at Sands Anderson PC and TrustBuilders Law Group. His practice focused on estate planning and trust creation and administration, with an emphasis on special needs trust planning due to his personal experiences with special needs issues in his family.
