Webcast: 10 minutes prior to seminar. If you register for a webcast the day of the seminar, your e-mail receipt will include a link to launch the seminar and download the materials.

Walk-in registration is permitted on a space-available basis

Cancellation Policy: Cancellation/transfer requests will be honored until 5:00 p.m. the day preceding the seminar. You will, however, be charged $40 if you cancel or transfer your registration to a different seminar after the link to the materials has been e-mailed by Virginia CLE.

Full refunds or transfers are available up to two days after a webcast in the unlikely event that you experience technical difficulties.

MCLE Credit Caveat: The MCLE Board measures credits by the time you spend in attendance. If you enter a seminar late or leave it early, or both, you must reflect those adjustments accurately in the credits you report on your credit reporting form. A code will be given at the end of the seminar, which must be written on your MCLE form.

2:00 Handling Intellectual Property Assets in Succession Planning and Trust Administration: When Ideas Are Property—IP Assets in an Estate Plan

This session will review the different types of intellectual property (“IP”) that might be owned by an estate, the assignment and ownership issues for IP, an overview of IP focused trust and estate principles, and issues with enforcement and maintenance of IP rights in the lifecycle of an estate plan. We also will discuss litigation concerning some celebrity estates with significant IP assets.

3:00 Ethical Considerations and Potential Sanctions When Appearing Before the Patent Trial and Appeal Board

The Patent Trial and Appeal Board (“PTAB”) of the U.S. Patent and Trademark Office receives nearly 1,500 inter partes review (“IPR”) and post-grant review (“PGR”) petitions annually. Experienced practitioners designed this course to educate attorneys on some of the possible ethical errors and pitfalls when practicing before the PTAB. This session will examine some of the disciplinary and sanctions decisions issued by the PTAB and discusses strategies to avoid missteps before the PTAB.

  • PTAB decisions identifying and addressing attorney conduct
