Information

Why Attend?

  • Get an overview of state and federal constitutional rights in K-12 education
  • Listen to a caselaw update on student and parental rights, Critical Race Theory, and sexual orientation and gender identity issues
  • Learn from a panel of attorneys with diverse educational law experience as they discuss the complex issues in K-12 education
  • Better represent parents and school officials by understanding the pertinent and current state of constitutional and statutory law as it relates to K-12 education

Do you have potential clients calling your office asking what their rights are as parents of K-12 public school students? Are you an attorney who represents and advises school divisions and officials? If so, this program is for you!

The United States and Virginia Constitutions both provide for individual free speech rights and religious liberties. Title VI prohibits discrimination on the basis of race, color, and national origin in programs and activities receiving federal financial assistance. Title IX prohibits discrimination on the basis of sex in education programs and activities receiving federal financial assistance. Seemingly these are all individual rights that would never run afoul of other rights, but it is not that simple. The current landscape of K-12 public school education is more complicated than ever before.

In this two-hour seminar, our faculty, with diverse experience in education law, will provide an overview of constitutional (both Virginia and federal) free speech rights and religious liberties relevant to K-12 education; an in-depth discussion on Title VI, including with respect to Critical Race Theory; and Title IX as it relates to sexual orientation and gender identity in public education, use of intimate facilities, and participation in athletics. You will also receive an update on the new cases being litigated in the state and federal courts on all these topics.
