Topics Covered

Get answers to these questions:

  • What is the governing law, history, and purpose of a Pooled Special Needs Trust (PSNT)?
  • When a spouse or child with special needs is involved, what special consideration must be taken to protect their current or future means-tested public benefits?
  • What are the fiduciary responsibilities and duties of a PSNT?
  • What is the impact of support payments on the individual’s eligibility for Supplemental Security Income (SSI) and even Medicaid?

Divorce is a difficult process for everyone involved, but choices made during a divorce can have lifelong repercussions for a parent and child with special needs. If a spouse or child with special needs is involved, special consideration must be given to protecting them in the divorce.

While family law attorneys are well-trained in the complicated world of divorce settlement, they may not have all the answers for the divorcing parties when a spouse or child has special needs. What is the effect of child support on public benefits? What are the parents’ support obligations for an adult disabled child? What are the options to ensure the best interests of the disabled family member are considered? Learn how planning for the future is key to ensuring their quality of life to the extent possible.
