Attorneys must be able to properly advise their clients regarding the importance of electronic evidence prior to litigation, including the ways of obtaining needed electronic evidence for litigation and laying the proper foundation for its identification and introduction into evidence.

Presented by an attorney and a digital forensic examiner, this program will explain how to use various aspects of social media, cell phone, and electronic evidence and how to effectively use electronic evidence. A skilled digital forensics examiner who has qualified as an expert witness in state and federal courts will teach you how to acquire this essential data. Digital forensics in the areas of e-mail, Internet usage, and electronic documents metadata and the proper methods of searching for, obtaining, and preserving these forms of electronic evidence will also be explored.

Webcast: 10 minutes prior to seminar. If you register for a webcast the day of the seminar, your e-mail receipt will include a link to launch the seminar and download the materials.
Telephone: Online registration ends at 11:59 p.m. the day preceding the seminar

Walk-in registration is permitted on a space-available basis

Cancellation Policy: Cancellation/transfer requests will be honored until 5:00 p.m. the day preceding the seminar. You will, however, be charged $40 if you cancel or transfer your registration to a different seminar after the link to the materials has been e-mailed by Virginia CLE.

Full refunds or transfers are available up to two days after a webcast in the unlikely event that you experience technical difficulties.

MCLE Credit Caveat: The MCLE Board measures credits by the time you spend in attendance. If you enter a seminar late or leave it early, or both, you must reflect those adjustments accurately in the credits you report on your credit reporting form. A code will be given at the end of the seminar, which must be written on your MCLE form.

ABOUT THE SPEAKERS

Eric Grabski, Envista Forensics / Morrisville, NC

Eric Grabski is an expert witness specializing in historical cell site analysis, call detail record analysis, and mobile device forensics. He is currently a Senior Digital Forensic Examiner with Envista Forensics, where he provides consultation to attorneys regarding criminal and civil litigation. Mr. Grabski began his career in law enforcement as a Special Agent with the South Carolina Law Enforcement Division (SLED). During his career at SLED, he was assigned to the State Surveillance and Intelligence Unit where his primary role was conducting historical and live cell site location analysis to locate violent fugitives, missing persons, and missing children. While at SLED, Mr. Grabski was deputized as a Special Deputy U.S. Marshal on the South Carolina Electronic Crimes Task Force, where his unit worked alongside the United States Secret Service assisting with fugitive apprehension. He has experience utilizing pen register trap & traces, GPS location analysis, mobile device forensics, and social media records analysis to assist local and federal agencies on major cases. Mr. Grabski is a Certified Telecommunications Network Specialist (CTNS), Certified Wireless Analyst (CWA), Cellebrite Certified Operator (CCO), and Cellebrite Certified Physical Analyzer (CCPA). He has testified as an expert witness in state and federal courts in the areas of historical cell site analysis, call detail record analysis, and mobile device forensics. Mr. Grabski has over 300 hours of training in cellular location analysis, wireless communications theory, and mobile device forensics.

Daniel L. Gray, Cooper Ginsberg Gray / Fairfax

For over 25 years, Daniel Gray has represented clients in Northern Virginia who need family law assistance. After graduating from the George Mason School of Law in 1996, he clerked for a Fairfax Circuit County Court trial court judge. He co-founded the firm of Cooper Ginsberg Gray in November 2004.

Mr. Gray has dedicated much of his professional life to improving the practice of family law. He currently serves as the Chairman of the Virginia Bar Association’s Family Law Coalition, a group of attorneys who propose, track, advocate, and advise on family law bills pending before the Virginia General Assembly each legislative session. Mr. Gray is a proud member of the Virginia Chapter of the American Academy of Matrimonial Lawyers, where he served as President from 2019 to 2021, and he currently serves on the AAML National Board of Governors. He was appointed by Governor Northam to the Virginia Child Support Guidelines Review Panel in 2020. Mr. Gray is former Chairman of the Virginia State Bar’s Family Law Section Board of Governors, and he served as Chairman of the Fairfax Bar Association’s Family Law Section for many years before retiring from that role in 2015. He often lectures and teaches other attorneys and paralegals on family law topics, ethics, and evidence. Mr. Gray is a current board member and past Board Chairman of Pathway Homes, Inc., a Fairfax non-profit that provides non time-limited housing and services to Virginians with mental illness.
