  • The Pregnant Workers Fairness Act (PWFA): this new federal law goes into effect on June 27, 2023; how will it change the workplace?
  • First Amendment Rights vs. LGBTQ Rights: where are courts drawing the line when those rights come into conflict?

Webcast: 10 minutes prior to seminar. If you register for a webcast the day of the seminar, your e-mail receipt will include a link to launch the seminar and download the materials.

Walk-in registration is permitted on a space-available basis

Cancellation Policy: Cancellation/transfer requests will be honored until 5:00 p.m. the day preceding the seminar. You will, however, be charged $90 if you cancel or transfer your registration to a different seminar after the link to the materials has been e-mailed by Virginia CLE.

Full refunds or transfers are available up to two days after a webcast in the unlikely event that you experience technical difficulties.

MCLE Credit Caveat: The MCLE Board measures credits by the time you spend in attendance. If you enter a seminar late or leave it early, or both, you must reflect those adjustments accurately in the credits you report on your credit reporting form. A code will be given at the end of the seminar, which must be written on your MCLE form.

Experienced practitioners discuss the ethical dilemmas that can arise in employment litigation when trying to comply with Rule 4.2 of the Virginia Rules of Professional Conduct, which prohibits communication with a represented person. Issues include contacting former employees of the defendant employer, concerns that settlement offers are not being conveyed, and other potential problems.

10:45 Is the Sun Setting on Non-compete Agreements in the U.S.?

The assault on the use of non-compete agreements has moved from the states to the federal level with the introduction by the Federal Trade Commission of a proposed rule banning non-competes. This session will examine the contents of the FTC’s proposed rule, the likely future of the proposed rule, and the status of state legislation banning or limiting non-competes, particularly in Virginia, DC, and Maryland.

A survey of the current interplay between anti-discrimination laws and the Free Speech Clause, with a focus on current Virginia and Fourth Circuit law on the issue, a refresher on the backdrop from Masterpiece Cakeshop, and a snapshot of the pending Supreme Court case in 303 Creative v. Elenis, including a predictive forecast based on oral arguments.

1:30 Practical Strategies in Conducting a Celebrity Trial

Lead counsel from the case of Depp v. Heard discuss the legal challenges of trying a case that is being covered by social media throughout the world. Topics will include picking a jury when a party is one of the most recognizable faces in the country, the importance of motions in limine, managing a packed courtroom, challenges with the effectiveness of videotape and Zoom testimony, and strategies for keeping the jury from getting caught up in all of the hoopla.

This session will examine the PWFA as it goes into effect on June 27, 2023, along with recent extension of pregnancy protections encompassed in the Virginia Values Act. The presenters also will consider how the courts have interpreted the 2015 Supreme Court decision in Young v. United Parcel Service.
