Now in its 41st year, Virginia CLE®’s Annual Real Estate Practice Seminar continues to set the standard for currency and quality in continuing legal education for real estate practitioners. Whether you have an established real estate practice or are a general practitioner who occasionally encounters real estate issues, this program is for you.

Options for Attending the Seminar

On Tuesday, May 9, this program will offer the following attendance options, all qualifying for live-interactive MCLE credit:

  • Live on Site in Richmond/Innsbrook: SOLD OUT. To be added to a waiting list to attend in Richmond, please email Kim at kvillio@vacle.org
  • Remote Live on Site in Roanoke: Join with other attendees at the Roanoke Higher Education Center and view the full seminar remotely on a large screen, live-streamed from the presentation in Richmond. Ask questions of the speakers in real time via a proctor. Network and socialize with your colleagues attending here. Lunch will be provided.
  • Virtual via live-interactive Webcast or Telephone: Attend the full seminar conveniently from your home or office and ask questions of the speakers in real time.

On Wednesday, May 17, this program will be presented Live on Site in Fairfax at the CrystalView Events and Conference Center only, with no virtual attendance options. Lunch will be provided, and you can network and socialize with your colleagues at the program. All speakers will be present at this location.

Webcast: 10 minutes prior to seminar. If you register for a webcast the day of the seminar, your e-mail receipt will include a link to launch the seminar and download the materials.
Telephone: Online registration ends at 11:59 p.m. the day preceding the seminar

Live on Site: Online registration ends at 11:59 p.m. the day preceding the seminar
Walk-in registration is permitted on a space-available basis

Cancellation Policy: Cancellation/transfer requests will be honored until 5:00 p.m. the day preceding the seminar. You will, however, be charged $90 if you cancel or transfer your registration to a different seminar after the link to the materials has been e-mailed by Virginia CLE.

Full refunds or transfers are available up to two days after a webcast in the unlikely event that you experience technical difficulties.

MCLE Credit Caveat: The MCLE Board measures credits by the time you spend in attendance. If you enter a seminar late or leave it early, or both, you must reflect those adjustments accurately in the credits you report on your credit reporting form. A code will be given at the end of the seminar, which must be written on your MCLE form.

The Real Property Section of the VSB undertook a review of all Legal Ethics Opinions to determine what applies specifically to real estate, what is outdated, and what is valid in our current time. That project is still being processed. This session will review a small portion of the results dealing with conflict of interest, duty to disclose, multiple representation, and unrepresented parties. We will cover numerous LEOs including 1564 and 1742, as well as Rules of Professional Conduct 1.1 (competence), 1.7, 1.8, 1.9 (conflict of interest), 1.15 (safekeeping property), and 4.3 (dealing with unrepresented persons).

3:45 Interpleader Actions: What to Do with Money That Doesn’t Belong to You

Holding onto other people's money is like playing hot potato: if you don't pass it along quickly enough, you could end up burning yourself. An interpleader is one tool that attorneys, real estate professionals, and fiduciaries can use to prevent that from happening. This session will cover interpleader actions, including procedural aspects of Va. Code § 8.01-364, situations they can be used, and rights of claimants to disputed funds. It will also cover Rule 1.15 of the Rules of Professional Conduct (safekeeping property), real estate professionals' statutory and fiduciary obligations regarding funds in their custody, and the consequences of mishandling money that doesn't belong to you.
