Information

Why Attend?

  • Understand how to authenticate all types of evidence under the rules in Virginia
  • Examine the various privileges that exist and how they can be voluntarily or involuntarily waived
  • Get an extraordinary set of written materials, the electronic version of Virginia CLE®’s A Guide to the Rules of Evidence in Virginia—a $90 value—included in the regular registration fee! (If you already own the 2022-2023 edition of this handbook and do not want the e-book version, you may register at a discounted rate.)

In many cases, the outcome of a trial comes down to the evidence. It is important for counsel to be familiar with the rules of evidence, because even the best evidence is useless if it cannot be admitted. This program will examine two of the rules: authentication and privileges. Learn about the practical applications of these rules to authenticate any piece of evidence, and understand what evidence may be protected because it involves communications with special relationships based on confidentiality.

Join us for a discussion on these two important rules of evidence with an experienced civil litigator who will guide you through the basics and best practices when it comes to authentication and privileges.

Topics will include:

  • Best practices for authentication
  • Self-authentication and application statutes
  • Laying the foundation for the authentication of internet communications, videos, cell phone records, social media content, photographs, etc.
  • Existence of privileges
  • Waiver of privileges
