  • For more experienced trademark practitioners, important facets of the latest developments are discussed along with the best practices for handling them

The Trademark Modernization Act of 2020 amends the Lanham Act and has made significant changes to practice protocols at the U.S. Patent and Trademark Office (USPTO), especially in regard to the kinds of applications that are permitted. This program provides an update on the most important recent developments in trademark and examines the significant details and best practices while providing practice pointers for handling these changes in the law.

Join us for this essential program taught by John Farmer, an intellectual property attorney with over 30 years of experience in trademark law. Mr. Farmer has taught an annual update on recent developments in trademark law for Virginia CLE® for over 15 years.

Topics include recent administrative developments at the USPTO that will affect your practice and expert evaluation of the Trademark Modernization Act and other trending topics, including answers to the following questions:

  • Do mark-infringement settlements that limit online advertising violate antitrust law?
  • Does the First Amendment protect referencing public figures in trademark registrations?
  • When are trademark rights overridden by First Amendment free-speech protection?
