Essential Elements of Private Sector Retirement Plans (and Why You Should Read Plan Descriptions Early and Often)

Employer-provided retirement benefit plans in the private sector come in all the colors of the rainbow and every shade of gray, but all have essential elements in common. This session will explain the essential elements as well as provide negotiation and drafting strategy suggestions to enable attorneys to more fully understand these plans, how their benefits can be divided, and how to draft appropriate settlement agreement and qualified order provisions to benefit the interests of their clients, whether they are participant or former spouses.

Understanding Full Disclosure and Transparency in Collaborative Divorce Cases

This session will delve into what disclosures are relevant and required under the Uniform Collaborative Law Act (UCLA), including whether a party is committing adultery. The speakers will discuss scenarios where a party does not want to disclose and how it impacts the process as well as the practical concerns about prejudicial information being revealed in a collaborative case that does not settle and ends up in litigation.

Judges Panel: Expert Witnesses and Evidence

A panel of judges will discuss effective (and ineffective) use of expert testimony as evidence, including (but not limited to) pretrial requirements, use of treating therapists as experts, and recent case law touching upon expert witness testimony.

Dan Gray and David Masterman, two experienced presenters on the matter of legal ethics, will team up and discuss issues of ethics in family law cases that at first may not have obvious solutions. Audience participation will be encouraged to help the group as a whole arrive at answers to tough questions, including: conflicts with witnesses; crimes discovered during the case; client secrets versus full disclosure; and representing the repugnant client.
