The course, recorded on November 18, 2021, provides the latest updates regarding vaccination mandates, from Brian Dean Abramson, Adjunct Professor of Vaccine Law at the Florida International University College of Law and the author of the first legal treatise comprehensively addressing all aspects of the law governing vaccines.

With events moving at a dizzying pace, it is vital for businesses and the attorneys who counsel them to understand the parameters of the Biden Administration‘s vaccination mandates. These include the Occupational Safety and Health Administration (OSHA) Emergency Temporary Standard (ETS) for businesses with over 100 employees (as well as the previous OSHA ETS for businesses in the healthcare sector), the Centers for Medicare and Medicaid Services (CMS) for participants in those programs, and the vaccination requirement for federal contractors.

The implementation of each of these mandates may further be affected by potential changes in state law, and the possible routes of legal opposition to these mandates by the state, employers, and employees will also be outlined.

Topics Covered Include:

  • Coverage of the respective OSHA, CMS, and Federal Contractor COVID-19 Vaccine Mandate Standards
  • What OSHA needs to show to support an ETS requiring employee vaccination, and how will its standard be challenged
  • Risks and benefits of establishing a vaccination mandate, or a testing and masking policy, under the OSHA standard
  • Potential interaction between the federal standards and Virginia law
  • Establishing a vaccination policy compliant with the appropriate standard
