Tenants and landlords of all types have been and are continuing to be devastated by the COVID-19 pandemic in Virginia and the onslaught of federal and state laws that directly affect all concerned. The CARES Act still applies and may affect the length of a landlord’s notice to cure. The Centers for Disease Control and Prevention has placed a moratorium on certain residential evictions, and the Virginia General Assembly is burdening landlords to assist their tenants in order to obtain rental assistance and avoid evictions for nonpayment of rent.

Commercial tenants are arguing the defense of force majeure as well other possible defenses while landlords are hoping to keep tenants in place with rent payments flowing. What are their choices?

ABOUT THE SPEAKER

Jerome P. Friedlander, II, Friedlander & Friedlander PC / McLean

Jerome P. Friedlander, II, is a member of the Virginia and District of Columbia Bars, at both state and federal levels including the U.S. Tax Court and the U.S. Supreme Court. He has served as a substitute judge in the Arlington County and later in the Fairfax County General District Court since 1985. He is past president of the McLean Bar Association (2009-10) and is its current treasurer; he is also past president of the Northern Virginia Chapter of the Federal Bar Association (1991-95). He is an honorary member in the Association of Fellows and Legal Scholars of the Center for International Legal Studies.

Mr. Friedlander is the author of Volume 8 of the Virginia Practice Series, Landlord-Tenant Law, updated each year, published by Thomson Reutter (originally published by Michie and then Lexis Law Publishing going back to 1992); The Broker’s Guide to Virginia Real Estate Law (Lexstone Publishing 2020 9th ed.); The Agent’s Guide to DC Real Estate Law (Peppercorn Paperworks LC, 2014); The Basics of Residential Landlord & Tenant Law (Peppercorn Paperworks LLC, 1989 with annual supplements); Chapter on Virginia Law in Legal Aspects of Doing Business in North American and Canada (Kluwer/West); and The Limited Liability Company—With a State by State Review (1994 The Michie Company, now out of print). 

Mr. Friedlander teaches Broker's Law as well as other real estate–related topics at the Northern Virginia Association of Realtors® (NVAR), and teaches landlord-tenant law and fair housing to various organizations, including NVAR, Northern Virginia Apartment Association (NVAA), and Virginia Association of Realtors (VAR), and various bar associations. Currently he is a member of the Wealth Counsel, a national organization of estate planning attorneys, and a past member of the National Network of Estate Planning Attorneys. He previously has taught advanced estate planning for the National Business Institute and NEPA.

Mr. Friedlander received his B.S. degree from Georgetown University in 1965, and his LL.B. degree from the University of Virginia School of Law in 1968. He is a former Captain with the 82nd Airborne Division with service in Vietnam.
