Ethics in Discovery in the Age of Highly Contested Divorces and Social Media

During the age of Social Media, how do we best advise our clients regarding editing, deleting, or otherwise altering posts so that they do not inadvertently prejudice themselves in the litigation? What do we tell them about deleting text messages before, during, and after the commencement of a lawsuit?  This segment will offer a spirited discussion regarding the nuances of good advice versus spoliation. We will also discuss the ethical gray area that has opened as a result of platforms such as “snapchat” where deletion is not always an overt act.
