This course is designed to guide counsel through the surprising array of legal issues that can arise within the context of vaccination, including an expected COVID-19 vaccine, from responses to vaccination mandates to recovery for vaccine-related injuries.

Vaccination has been ubiquitous in our society for decades. Many of our most important areas of law—education, labor, privacy, tort—have special exceptions carved out for the purpose of promoting or even mandating vaccination of the population.

Legal issues arise from many of these policies. Parents may wish to know their options with respect to the vaccination of their children, particularly where they have concerns regarding possible adverse reactions to vaccination. Who prevails where the parents have differing views on the subject? Private sector employees, particularly in the healthcare industry, may also face vaccination mandates from their employers, and may wish to know what their rights are with respect to such rules. Although actual vaccine-related injuries are rare, attorneys should be aware of the specialized tribunal that has been established to adjudicate most such claims. Lastly, the emergency measures deployed with respect to an expected COVID-19 vaccine invoke additional statutory and regulatory regimes, which will quickly become important for employers, agencies, and potential vaccine recipients to be aware of.

ABOUT THE SPEAKER

Brian Dean Abramson, Esq., LL.M. / Falls Church

Brian Dean Abramson is the author of Vaccine, Vaccination, and Immunization Law, the first legal treatise comprehensively addressing all aspects of the law governing vaccines, published by Bloomberg Law and cosponsored by the American Health Lawyers Association. Since the advent of the COVID-19 pandemic, he has completed numerous articles and presentations on the implications of a potential COVID-19 vaccine. 

Mr. Abramson has practiced intellectual property law and previously authored the vaccine injury claims chapter of Bloomberg Law’s Court of Federal Claims: Jurisdiction, Practice, and Procedure.

Mr. Abramson was a law clerk for the Honorable Pauline Newman of the U.S. Court of Appeals for the Federal Circuit, where his work included reviews of both vaccine-related patent cases and vaccine injury claims.

Mr. Abramson received his J.D. from the Florida International University College of Law, and his LL.M. in intellectual property law from the George Washington University Law School.
