A pre-recorded streaming video replay of the April 2020 webcast, Common Law Business Torts in Virginia.

Topics Covered

There’s often more to a business dispute than just a contract claim.

  • Learn about the tort-based claims that can arise between business parties
  • Understand the elements of each cause of action
  • Just because you can doesn’t mean you should: Know when, and when not, to make these claims

Think of a “business dispute,” and almost inevitably you first will think of a claim based on breach of contract. Yet many times the facts may give rise to separate tort claims, and several of these tort claims may be available absent any contractual relationship.  Within the broad category of Business Torts are both common law and statutory claims under Virginia law.  Understanding how to assert these tort claims is a skill every business lawyer and litigator should possess.

This seminar will help provide that understanding, addressing, among other matters, the following causes of action:

  • Common law and statutory business conspiracy
  • Fraud
  • Defamation
  • Tortious interference with contractual relations and business expectancies
  • Oppression of minority shareholders
  • Infliction of emotional distress
  • Assault and battery
  • Employer liability for employee actions

Using the “Common Law Torts” chapter from our Virginia Business Torts (2019 edition) publication, and the “Tort Actions” chapter from our Employment Law (2020 edition) publication, our speakers will cover procedural aspects, elements of proof, and available damages for each claim.
