Our Constitution gives Congress the power “To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries.” Little could the Founders have imagined how broad this right has become, especially given the expansion of works eligible for protection and the ease with which copies can be made today. Infringement is literally child’s play—a scary thought for lawyers (and parents!).

Copyright pervades our society. You need not be an intellectual property lawyer to encounter copyright issues frequently in your practice. If you don’t understand how a copyright is secured, what it protects, its limited exceptions, and serious sanctions, you may not be serving your client’s interest as well as you could. ABOUT THE SPEAKERS

Our two speakers are co-authors of the Virginia CLE® publication Intellectual Property Law in Virginia.

Thomas M. Dunlap, Dunlap Bennett & Ludwig PLLC / Vienna
Thomas M. Dunlap is the managing partner of Dunlap Bennett & Ludwig, which registered more than 1,400 new trademarks in 2018, and is ranked as an IP Watchdog Top 100 firm for patents. Mr. Dunlap’s practice focuses on intellectual property, recently winning a $30 million jury verdict in the Eastern District of Texas in a patent infringement matter and he has handled numerous appellate cases before the Federal Circuit. Mr. Dunlap is the author of several books, including Chambers International guide to trademarks, and Virginia CLE’s Essentials of Intellectual Property, and has been named a Virginia and Washington D.C. SuperLawyer and a Legal Elite, as well as Leader in the Law by Virginia Lawyer’s Weekly. Mr. Dunlap is a Certified Patent Valuation Analyst and is a patent holder and founder of the biotechnology company Ceres Nanosciences, Inc. He is the past president of the Loudoun County Bar and has served as a special prosecutor. Mr. Dunlap received his B.A. from Lafayette College and his J.D. from Washington & Lee University and has a dual degree (M.S. Biotechnology/ M.B.A.) manga cum laude from the University of Maryland. He is a graduate of Army OCS and has commanded an infantry company in the U.S. Army.

David Ludwig, Dunlap Bennett & Ludwig PLLC / Leesburg
David Ludwig is a partner at Dunlap Bennett & Ludwig PLLC and co-chair of the firm’s litigation group. Mr. Ludwig’s practice focuses on intellectual property disputes in the areas of copyright, patent, trademark, and domain names, in addition to commercial transactions and government contracts. He has represented manufacturing companies in complex patent infringement matters, technology companies in trademark infringement matters, and copyright holders in infringement actions against companies that include Disney, ABC, and Oracle. Mr. Ludwig is an adjunct professor on intellectual property matters at The George Washington University Law School, and he has taught numerous CLE courses on intellectual property and domain name issues. He maintains an “AV Preeminent” peer review rating from Martindale-Hubbell and has been included in Virginia Business magazine’s Legal Elite.
