Information

Why Attend?

  • Examine the up-to-date ethical rules that can impact social media usage
  • Identify how social media impacts the practice and business of law with reference to real-world examples and hypotheticals
  • Learn best practices when dealing with social media

Social media, whether it is Facebook, Twitter, LinkedIn, or another platform, is just a tool, used by clients/witnesses/jurors to express themselves and by lawyers in their practice or to market their business. Just like any other technological development, there are some disruptions, learning curves, and bumps to iron out. Just because it may be new or unfamiliar does not mean an attorney has to (or should) avoid social media.

This seminar will identify how social media impacts the practice and business of law, and best practices for attorneys when dealing with social media. It will discuss many of the popular social media platforms and work through the numerous Virginia Rules of Professional Conduct that apply to its use. Real-world examples and hypotheticals will be used to teach attorneys about their ethical obligations regarding social media and suggested use to help further their business.

Topics to be covered include:

  • Introduction to Social Media Sites
  • Ethical Concerns with Social Media
    • General duty of competence
    • Commenting on pending trials
    • Pretexting
    • Criticism of judges
    • Confidentiality
    • Litigation concerns
  • Marketing and Social Media Use
    • Updated marketing rules
    • Endorsements
    • Case results
    • Direct solicitation
    • Examples of ethical use in marketing
