Cosponsored with the Real Property Section of the Virginia State Bar

Now in its 37th year, Virginia CLE®’s Annual Real Estate Practice Seminar continues to set the standard for currency and quality in continuing legal education for real estate practitioners. Whether you have an established real estate practice or are a general practitioner who occasionally encounters real estate issues, this program is for you.

Buying or selling real estate, whether residential or commercial, may be the largest single investment that your client will ever make. Along with a considerable financial commitment, such transactions usually involve risk, technicalities, and a variety of complex legal considerations.

This year’s topics include:

  • Essential Updates on Virginia Real Estate Case Law and Statutory Law
  • Easements—The Changing Landscape and Scope
  • An Overview of Landlord-Tenant Law in Virginia
  • Ethics for the Real Estate Attorney

Easements: The Changing Landscape and Scope
John H. Hawthorne

The Supreme Court of Virginia has been clear that we look to the specific language of the easement to define its scope. The Code of Virginia has dictated that an easement will not be used in a way that is not reasonably consistent with the uses contemplated by the grant of the easement. However, easements have all too often fallen into a gray area in between. How do we determine the rights of the dominant tenement and the duties of the servient tenement when the language and intended use are both ambiguous? Furthermore, as the use of the land associated with the easement evolves, does the use of the easement correspondingly evolve? These questions and many others will be analyzed and discussed in this presentation.

Landlord-Tenant Overview
Elizabeth Godwin-Jones

The presentation will provide a basic overview of landlord-tenant law with an emphasis on the Virginia Residential Landlord Tenant Act (VRLTA). Focus areas will include recent changes to the VRLTA, particularly in light of a growing awareness of eviction rates around the state, as well as issues commonly experienced by purchasers of residential and commercial real property. The material will also take a basic look at bankruptcy law as it affects landlord-tenant proceedings.
