An annual seminar designed by the Military Law Section of the Virginia State Bar to highlight unique issues attorneys should know to professionally represent and assist current or former service members and their families

The Commonwealth of Virginia is home to one of the largest percentages of active duty and former military service members in the United States. Regardless of what type of law you practice, you eventually will encounter service members and their families as your clients. In this annual seminar, cosponsored with the Military Law Section of the Virginia State Bar, learn about some unique issues you need to know to professionally represent and assist these current or former service members and their families.

Topics covered:

  • Gain a greater understanding of International Humanitarian Law and explore how ordinary people placed in leadership positions during wartime balance personal and institutional perspectives on morality, law, and leadership
  • Receive an overview of the recently passed Veterans Appeals Improvement and Modernization Act and the current process for making a claim and the right to appeal under Veterans Administration regulations 
  • Review the significant updates to the Uniform Code of Military Justice that went into effect on 1 January 2019, including voir dire and panel selection, plea agreements, and sentencing
  • Understand the practical challenges of implementing the Servicemembers Civil Relief Act standards and provisions in courts and receive some recommendations on best practices when assisting a client on an SCRA issue

The Procedures and Practical Challenges of the Servicemembers Civil Relief Act
Dwain Alexander II

A review of the Servicemembers Civil Relief Act (SCRA) and the challenges of implementing the SCRA standards and provisions in courts. The presentation will include a discussion of local cases where the SCRA standard was not met in court, and some recommendations on best practices when assisting a client on an SCRA issue.
The Current State of the Veterans Appeals Process
Daniel G. Krasnegor

In 2017, Congress passed the Veterans Appeals Improvement and Modernization Act. This session will review the changes directed by the Act, and the current process for making a claim and the right to appeal under Veterans Administration regulations.
The Ethics of Professional Communication: Tips, Tricks, and Traps
Prescott L. Prince

Professional communication involves more than just communication with the client. Attorneys employed by large organizations may also have responsibilities to superiors or subordinates in rank while maintaining client confidences. Attorneys may also be overwhelmed by the information received from clients or other sources. This presentation will discuss the various Rules of Professional Responsibility implicated, and include suggestions for improving efficiency of communication and controlling the flow of incoming information.
Ordinary Soldiers: A Review of International Law, War Crimes, and Obedience to Orders
Jody M. Prescott

Using a historical case study, and based on the research of Dr. Waitman Wade Beorn in his book Marching into Darkness, designed by the U.S. Holocaust Memorial Museum and the Center for Holocaust and Genocide Studies at West Point, this session will explore how ordinary people placed in leadership positions during wartime balance personal and institutional perspectives on morality, law, and leadership as they decide the fate of legally protected populations. International Humanitarian Law topics discussed include: War Crimes, Geneva Convention IV Relative to the Protection of Civilian Persons in Time of War, and the Obedience to Orders defense.
