This presentation will summarize recent case law and trends in litigation specific to government contractors. Practitioners will benefit from real-world examples of lessons learned in areas such as bid protests, contract claims, and prime-sub disputes.

10:00 This Too Shall Pass Through: The Severin Doctrine and Its Impact on Pass-Through Claims and Liquidating Agreements

This presentation will look at pass-through claims and the considerations both subcontractors and prime contractors may have in passing such claims up to the government. The speakers will also discuss the impact that the Severin Doctrine has on the parties’ analysis and in the crafting of Joint Defense/Common Interest Liquidating Agreements.

11:20 Practice Tips Before the Board of Contract Appeals

This panel of three judges will provide insight and suggestions for litigating before Boards of Contract Appeals, including the Civilian Board of Contract Appeals (CBCA) and the Armed Services Board of Contract Appeals (ASBCA).  The panel will discuss topics such as the CBCA's new rules after one year, the electronic filing process, the use of the Rule 4 appeal file, how to approach a Board hearing, motions practice, jurisdictional issues, and alternative dispute resolution.

This presentation will review requirements and best practices for presenting and proving delay and disruption claims both at the project level and, failing resolution, at the Boards and Court of Federal Claims. The presentation will focus on the scheduling and pricing methodologies that have been accepted, and those that have been rejected, so that practitioners can best advise their clients on how to maximize equitable adjustments.
