Our lives have become so dependent on electronic devices, especially in the workplace. And every bit of work on those devices leaves tracks—tracks that, in a litigation context, may be of critical importance to the outcome of the case.

E-discovery, in the eyes of many, is partly responsible for the decreased number of cases going to trial: it is often just too hard, and in almost every case too expensive, to pursue a case to verdict. The burdens of e-discovery are unlikely to ease anytime soon. The attorney who fully understands the rules related to e-discovery, and the insight on how to use those rules to the client’s advantage, will have a leg up on the opposing side. The attorney cannot do it alone, however: the client must be an equal partner in the effort after the litigation begins, and preferably long before.

This seminar will provide you with a thorough grounding in the diverse aspects of e-discovery. Our experienced speakers—with responsibilities for e-discovery matters on the law firm side and on the in-house counsel side—will present a holistic method for identifying, confronting, and prevailing over e-discovery challenges.   • An overview of (i) state and federal rules addressing the discovery of electronically stored information; (ii) the key phases of e-discovery (identification / preservation / analysis and review / production / presentation); and (iii) emerging trends involving the concepts of reasonableness, proportionality, and cooperation
  • A summary of recent, notable e-discovery decisions, including cases from Virginia state and federal courts
  • The view from in-house—a discussion of what organizations need to know about e-discovery, how they can implement policies and procedures to handle key aspects of e-discovery in-house, and when they need to call for help

Webcast: 10 minutes prior to seminar. If you register for a webcast the day of the seminar, your e-mail receipt will include a link to launch the seminar and download the materials.
Telephone: Online registration ends at 11:59 p.m. the day preceding the seminar
Call (800) 979-8253 to register up to one hour prior to the seminar
Live on Site: Online registration ends at 11:59 p.m. the day preceding the seminar
Walk-in registration is permitted on a space-available basis

Cancellation Policy: Cancellation/transfer requests will be honored until 5:00 p.m. the day preceding the seminar. You will, however, be charged $40 if you cancel or transfer your registration to a different seminar after the link to the materials has been e-mailed by Virginia CLE.

Full refunds or transfers are available up to two days after a webcast in the unlikely event that you experience technical difficulties.

MCLE Credit Caveat: The MCLE Board measures credits by the time you spend in attendance. If you enter a seminar late or leave it early, or both, you must reflect those adjustments accurately in the credits you report on your credit reporting form. A code will be given at the end of the seminar, which must be written on your MCLE form.
