Topics Covered

The plaintiff has been awarded damages. Now what?

  • Explore the many steps between being awarded monetary damages and actually receiving the money
  • Understand the intricacies of liens and other claims on the award
  • Learn what to do when the defendant doesn’t pay the award

The verdict has been reached: $$$ for your plaintiff client. Time to celebrate? Better hold the champagne for a little while.

There are many challenges awaiting the civil litigator between announcement of a monetary award and depositing the money in the client’s bank account. Yet being proficient at handling these challenges is nearly as important as the trial work that secured the verdict in the first place. This seminar is designed to outline the steps that must be taken in order to ensure the proper distribution of the award, including that to stakeholders other than the plaintiff. Among the topics our expert speakers will address are:

  • Dealing with post-trial motions
  • Considerations when you get paid
    • Liens
    • Set-asides
    • Assignments
    • Workers’ compensation
    • Attorney liens
    • Dealing with other “loans”
    • Structuring payments
  • What to do when you don’t get paid
    • Docketing the judgment
    • Collecting
  • The Hybrid; or what happens with an excess verdict
    • Bad faith/assignments
    • “We’ll cover you” letters from insurance companies
    • Releases
  • Releasing the judgment
