Social media has become a pervasive part of our modern culture, including in the workplace. Employee access to the Internet and the corresponding ability to communicate information at any time from any place creates both advantages and disadvantages for employers. As valuable as the use of social media can be for employers—for example, in recruiting, marketing, or making resources available on a shared venue for employees working in different geographic locations—the breadth of social media use increases the possibility that employers will have to address an employee’s online conduct. Striking a balance between allowing employees to use social media to advance the employer’s business interests on the one hand, and limiting an employee’s use of social media so that business interests are not jeopardized on the other hand, is challenging and not always intuitive.

This seminar will address two salient issues related to social media and the workplace: (1) the policies and procedures employers can (and should) establish in the workplace regarding social media use; and (2) the extent to which employers may discipline employees because of their use of social media.

ABOUT THE SPEAKERS

Michelle B. Radcliffe, IslerDare PC / Vienna

Michelle Bodley Radcliffe is a Partner with IslerDare PC. She has specialized in representing employers in employment matters for the past 20 years, and has litigated employment and commercial cases for more than 25 years. Her practice focuses exclusively on providing advice and counsel to clients on all substantive issues of employment law—including counseling and disciplining employees, employment policies, wage-hour issues, and employment agreements—and representing employers in administrative charges and litigation. In addition to her trial experience, Ms. Radcliffe has successfully obtained dismissals and summary judgment rulings in her clients’ favor. She is a regular speaker at CLE and HR and management training seminars on employee policies and handbooks, effective and lawful hiring practices, unlawful harassment and discrimination, and the FMLA and ADA. 

Ms. Radcliffe is a member of the Virginia, District of Columbia, and Maryland Bars. She graduated cum laude in 1987 from Wake Forest University and received her law degree in 1990 from the College of William & Mary, Marshall-Wythe School of Law, where she was an Executive Editor of the Law Review and served on the Judicial Council. She clerked for the Honorable James H. Michael, Jr., United States District Court, Western District of Virginia. Before joining Isler Dare, P.C., Ms. Radcliffe practiced in Washington, DC, with Gibson, Dunn & Crutcher, LLP. 

Amy E. Smith, IslerDare PC / Richmond

Amy E. Smith is a Senior Associate with IslerDare PC. Prior to joining Isler Dare, she practiced both management and employee-side labor and employment law with firms in Savannah, Georgia, and Tampa, Florida. Immediately after law school, she clerked with Georgia Superior Court Judge Tilman E. Self, III, and the Honorable C. Ashley Royal of the U.S. District Court for the Middle District of Georgia. 

Ms. Smith regularly advises clients on traditional labor issues and handles collective bargaining negotiations, arbitrations, union representation campaigns, and proceedings before the National Labor Relations Board. She frequently provides training to clients on traditional labor relations issues, workplace investigations, and compliance with the Service Contract Act, the ADA, the FMLA, and other employment laws.
