Information

A pre-recorded streaming video replay of the September 2018 webcast, Modifying and Terminating Irrevocable Trusts in Virginia.

Topics Covered

To provide your clients with adequate information and peace of mind when creating an irrevocable trust, it is necessary to understand the ways in which that trust can be revoked and/or modified in the future.

  • Learn what makes a trust irrevocable, and why it makes sense to draft one
  • Examine the circumstances under which an irrevocable trust may no longer be effective, and the requirements to change or revoke an irrevocable trust
  • Review the statutory mechanisms available to you when faced with an irrevocable trust that is no longer economical, practicable, or necessary
  • Gain an understanding of the potential pitfalls involved in pursuing modification or termination, in order to preemptively address them with beneficiaries and trustees alike
  • Analyze the statutes from a litigator’s perspective to understand how to avoid or prepare for litigation when seeking modification or termination of an irrevocable trust

As circumstances change, an irrevocable trust that at one time may have been a perfect fit may no longer serve the purpose for which it was intended. But how can you change the unchangeable?

The presenters will discuss the various ways to amend and revoke an irrevocable trust in Virginia. The presentation will focus on the statutory mechanics of altering or terminating such a trust, which on its face cannot be changed. A discussion of the process and procedure for such changes will be addressed with both practical and theoretical applications.
