Information

A pre-recorded streaming video replay of the October 2018 webcast, Essentials of Handling No-Fault Divorces in Virginia.

Topics Covered

An excellent primer, from a leading Virginia family law attorney, on how to efficiently and effectively handle no-fault divorces in Virginia for your clients—from the initial consultation through the final divorce decree. Topics include:

  • Basic requirements under Virginia law for a no-fault divorce
  • Considerations regarding client representation
  • The essential aspects of the Property Settlement Agreement
  • Considerations for spousal support, child custody, and child support
  • How “fault” can still be an issue in a no-fault divorce

Virginia’s divorce laws do not require “fault” grounds for a divorce to be granted. A no-fault divorce from the bond of matrimony may be awarded if certain conditions are met. This seminar will walk attorneys through the essentials of handling a no-fault divorce—from initial client consultation on the basic requirements for a no-fault divorce, to the creation of the Property Settlement Agreement, to an overview of court procedures, to the final divorce decree. It will also address spousal support, child custody, and child support considerations, including how fault may still be an issue when spousal support is being sought or can be a factor in determining the division of marital property.
