Even though a trust says that it is irrevocable, sometimes life intervenes and changes need to be made. Reformation and decanting provide methods by which an attorney can modify or redraft a trust so as to fulfill the grantor's intent in such situations. This session reviews the statutes and case law governing the process as well as pitfalls facing the practitioner.
