Are you interested in learning more about small business contracting programs? Do you understand the various factors to consider when pursuing a government contract through a joint venture or teaming agreement? Are you up to date with bid protests? This annual program, cosponsored with the Construction Law and Public Contracts Section of the Virginia State Bar, addresses these topics and more.

This course was specially designed to meet the requests from practitioners for quality programming in the field of federal government contracting. Now in its third year, this four-hour seminar, taught by experienced practitioners, focuses on tools for pursuit and payment.

Topics covered this year include:

  • An overview of the various small business contracting programs, including the basic requirements for each program and recent regulatory changes
  • A session on how to effectively use teaming agreements and joint venture agreements in the pursuit of government contracting
  • A presentation on bid protests, from the perspectives of both the Government and contractors
  • A discussion about considerations contractors must bear in mind when preparing requests for equitable adjustments and claims under federal contracts

COURSE TOPICS

Small Business Program Overview
Stephanie D. Wilson

The federal government spends billions of dollars each year on contracts with small businesses. This session will provide an overview of the various small business contracting programs, including Women-Owned Small Businesses (WOSB), SBA's 8(a) Business Development Program, Historically Underutilized Business Zones (HUBZone), Service-Disabled Veteran-Owned Small Businesses (SDVOSB), and the All-Small Mentor-Protégé Program. The speakers will review the basic requirements for each program and recent regulatory changes.

Joint Venture and Teaming Agreements for Government Contracts
Stephen B. Shapiro

The session will cover factors to consider in deciding to pursue a government contract through a joint venture or teaming agreement.  The speaker will discuss practical and legal considerations for negotiating and drafting a joint venture partnership and other forms of teaming agreements; management and decision-making authority within a joint venture and teaming arrangement; financing, insurance, and bonding considerations; compliance with the government contract statutes and regulations; resolving disputes among joint venture members; and managing upstream and downstream disputes.   

Recent Issues and Developments with Bid Protests

The speakers will discuss various protest issues from perspectives of both the Government and contractors. They will address protest trends at the various protest forums, and will also discuss the possible impacts of the DoD Pilot Program regarding the loser-pays policy, and enhanced debriefing rights.

Pricing Equitable Adjustments and Claims—Considerations Under the Federal Acquisition Regulation, Truthful Cost or Pricing Act, and Civil False Claims Act

This session will discuss considerations contractors must bear in mind when preparing requests for equitable adjustments and claims under federal contracts, such as applicable cost principles and certification and disclosure requirements.  The speakers will also provide an overview of possible consequences associated with noncompliance.
