This course provides detailed information about Virginia and federal eminent domain law and the valuation of both fee simple and easement interests in land.

To adequately represent a property owner and properly protect the owner’s rights, an attorney or real estate professional needs to understand the value of the client’s real estate. This course includes an analysis of the appraisal of real estate and applicable Virginia law.

Similarly for those attorneys and real estate professionals representing purchasers and lessees, an understanding of general eminent domain concepts is crucial to effectively represent these clients. Real estate sales contracts and leases regularly contain “condemnation clauses,” which address the rights of the parties if a condemnation occurs. Those clauses cannot be properly drafted and understood without a basic knowledge of eminent domain law in Virginia.

Further, a real estate professional may be asked to serve as an expert witness in a condemnation case to discuss things such as market conditions and valuation. Appraisers are always hired by both sides in a condemnation case. Real estate brokers are often retained to address market conditions and other issues related to value.

This seminar features an overview of the handbook, presented by the authors. These are some of the most well-known and respected attorneys in the practice of eminent domain, whether in private practice or government.
