The U.S. and Canada have the largest trading relationship of any two nations on earth. This leads to a concomitant amount of disputes, litigation, and arbitration. This program will address some of the most pervasive issues that arise during legal disputes that cross the borders between the U.S. and Canada from a Canadian perspective. The speakers will drill down on practical issues such as where to commence litigation and why; how to oust Canadian jurisdiction where appropriate; how to obtain evidence in Canada for use in U.S. proceedings; the impact of key Supreme Court of Canada decisions over the past 20 years on the enforcement of U.S. judgments in Canada; and substantive and procedural advantages and disadvantages of the use of Canadian proceedings. Every U.S. lawyer who deals with cross-border issues with Canada will learn from this seminar.

  • Learn what is involved in enforcing judgments cross-border and what impact the Supreme Court of Canada judgments have had on the trade relationship between U.S. and Canada

Jon-David Giacomelli, Cambridge LLP / Toronto, Canada

Jon-David Giacomelli is a founding partner in Cambridge LLP and the Chair of the Cross-Border and Business Litigation Groups. His practice encompasses a wide range of complex cross-border litigation and alternative dispute resolution, with an emphasis on private international law, conflict of laws, jurisdictional disputes, enforcement of foreign orders, shareholders rights, and injunctive relief. Jon-David has represented clients from around the world and is recognized in Canada, the U.S. and abroad as a leading practitioner in the area of cross-border litigation and arbitration.

Mr. Giacomelli is a frequent speaker and writer on issues related to business litigation, private international law, and in particular, cross-border litigation, dispute resolution, and conflict of laws. He has spoken and lectured widely at city, provincial, state, national, and specialty bar associations in Canada, the United States, South America, and Europe.

He is a graduate of McMaster University with a B.A. in Political Science (summa cum laude–1st in class) and Queen’s University LLB.  He has appeared at all levels of court in Ontario and in international arbitrations in Canada and the United States.

Chris MacLeod, Cambridge LLP / Toronto, Canada

Chris MacLeod is a Partner in Cambridge LLP. His practice focuses on complex business litigation including cross-border dispute resolution, multi-jurisdictional litigation, and private international law.

Mr. MacLeod is a frequent speaker and writer on topics relevant to cross-border litigation, conflict of laws, and private international law. He has appeared before all levels of court in the province of Ontario, including the Ontario Court of Appeal. He has also appeared before the Supreme Court of Canada as co-counsel for an intervenor in Canada (Prime Minister) v. Khadr, 2010 SCC 3, [2010] 1 S.C.R. 44.
