Cosponsored with the Construction Law and Public Contracts Section of the Virginia State Bar, this seminar series originated from the requests of many attorneys to have quality programming available on federal government contracting. Now in its second year, this four-hour seminar, taught by experienced practitioners, focuses on navigating the limits of contractor behavior for public contracts.

This session will cover statutory and case law support for common false claim issues arising on federal contracts, including false payment certifications, certified payroll issues, claim certification, and implied certification issues, including the impact of the Supreme Court’s 2016 decision in Universal Health Services v. United States ex rel. Escobar.

Suspension or debarment can have devastating consequences to companies that rely on the federal government for business as a prime contractor, subcontractor, or grantee. The presenter will discuss:
  • Statutory and regulatory basis structure for suspension and debarment
  • Trends in suspension and debarment activity, such as:
    • Types of cases
    • Various approaches agencies are using to resolve such actions
  • Best practices in compliance and ethics
    • Values-based ethics and compliance programs
    • Internal investigations
    • Disclosure practices
    • Engagement with suspension debarment officials
Ethical Pitfalls for Subcontractors on Federal Projects

State and Local Construction Project Ethics

This session will focus on contracting issues for state and local projects.  Topics include standards of conduct of government procurement officials under the Virginia Public Procurement Act, the State and Local Government Conflict of Interests Act, the Virginia Governmental Frauds Act, and cost and pricing fraud (improper substitutions, false claims, etc.).
