This two-hour interactive program will continue the exploration one of our profession's core duties—maintaining client confidences. Specifically, the program will explore lawyers’ confidentiality and disclosure duties in the context of non-clients’ misconduct. Using hypotheticals the program will address, among other things: determining what state’s ethics rules apply; lawyers’ possible duty to disclose non-clients’ felonies or child abuse; corporate lawyers’ “reporting up” employee misconduct; friendly and adverse non-clients’ false testimony; lawyers’ duty to report other lawyers’ misconduct (including lawyers subject to the duty, whom they must report, the reporting duty’s standards and timing, and the role of lawyers’ confidentiality duty).

Tom Spahn’s reputation as the expert on ethics is well deserved. What isn’t as evident from his résumé is how good he is as a lecturer: enlightening and engaging, yet always focused on relevant, real-world problems and their solutions.

Cancellation Policy: Cancellation/transfer requests will be honored until 5:00 p.m. the day preceding the seminar. You will, however, be charged $40 if you cancel or transfer your registration to a different seminar after the link to the materials has been e-mailed by Virginia CLE.

Full refunds or transfers are available up to two days after a webcast in the unlikely event that you experience technical difficulties.

MCLE Credit Caveat: The MCLE Board measures credits by the time you spend in attendance. If you enter a seminar late or leave it early, or both, you must reflect those adjustments accurately in the credits you report on your credit reporting form. ABOUT THE SPEAKER

Thomas E. Spahn, McGuireWoods / McLean

Thomas E. Spahn practices as a commercial litigator with McGuireWoods in Tysons, Virginia.  He was selected as the 2013 metro-Washington, DC "Lawyer of the Year" for "Bet the Company Litigation" by The Best Lawyers in America (Woodward/White, Inc.).  He has served on the ABA Standing Committee on Ethics and Professional Responsibility, and is a member of the American Law Institute and a fellow of the American Bar Foundation.  Mr. Spahn has written extensively on attorney-client privilege, ethics, and other topics, and has spoken at over 1,400 CLE programs throughout the U.S. and in several foreign countries.  He graduated magna cum laude from Yale University and received his J.D. from Yale Law School.
