Environmental regulations (e.g., those related to waste disposal, waste remediation, water discharges, water withdrawals, and air emissions) can be contentious issues that businesses and industries face in project planning and in day-to-day operations. This seminar will be an overview of the Commonwealth’s major environmental programs, with an emphasis on current issues, challenges, and regulatory activities related to air, water, and waste management in Virginia. It will offer substantive and practice-oriented topics that will interest real estate, land use, environmental, corporate, and general practitioners alike. Expect up-to-the-minute information and insights into latest information from Virginia’s top environmental regulators.

The course will be taught by division directors at the Virginia Department of Environmental Quality, Virginia’s regulatory agency and EPA-delegated authority for air, water, and waste programs. The speakers oversee all regulatory aspects related to implementation and compliance of Virginia’s laws and regulations pertaining to water quality, water quantity, waste disposal, air quality, and land protection and revitalization. In 2015 the Water division was split between permitting and planning. The Air division was expanded in 2016 to include renewable energy.

Melanie Davenport, Virginia Department of Environmental Quality / Richmond
As the director of Water Permitting, Melanie Davenport is responsible for storm water, VPDES permitting, bio-solids, wetlands, and compliance. She has held a number of positions at DEQ including Director of Water, Director of Enforcement, Assistant Director of Air Division, and as a special assistant to the Secretary of Natural Resources. Ms. Davenport also worked for the Virginia legislature, serving three years as the Virginia Director of the Chesapeake Bay Commission. Prior to returning to DEQ, she spent 10 years practicing environmental law at Troutman Sanders. Ms. Davenport received her B.A. from Boston University in marine biology and her law degree from William and Mary.

Mike Dowd is Director of the Air and Renewable Energy Division for DEQ. In that position, he oversees the air quality planning, permitting, compliance, monitoring, and mobile source programs, as well as the Small Renewable Energy Permit-by-Rule program for the Commonwealth. Prior to becoming Air Director, Mr. Dowd served as DEQ’s Enforcement Director. Before joining DEQ, he was an attorney in private practice with law firms in Richmond, Virginia, Washington, DC, and Columbus, Ohio. Mr. Dowd is a graduate of Columbia University and holds a J.D. from Vermont Law School. He is a recipient of EPA’s Bronze Medal. Mr. Dowd is Treasurer and Past Chairman of the Mid-Atlantic Regional Air Management Association (MARAMA), Chairman of the Mid-Atlantic Diesel Collaborative, Board Member and Co-Chairman of the Training Committee of the National Association of Clean Air Agencies (NACAA), Board Member and Treasurer of Southeast States Air Resources Management, Inc. (SESARM), and a member of the Executive Committee of the National Council on Electricity Policy.

Jutta Schneider began her public service with the Commonwealth of Virginia in 1998, working on Chesapeake Bay restoration activities as an analyst at the Department of Conservation and Recreation (DCR). From 1999 to 2007, she served at DCR and then the Department of Environmental Quality (DEQ) as project manager and program coordinator for the Total Maximum Daily Load program. Starting in 2007, she worked for eight years in DEQ’s Land Protection and Revitalization Division, serving in several coordinator and management roles. She assumed her current role as Director of DEQ’s Water Planning Division on June 10, 2015.

Justin L. Williams is the Director of Land Protection and Revitalization for DEQ. Prior to this position, he served as DEQ's Office of Waste Permitting & Compliance Director. This Division includes solid waste and hazardous waste permitting, remediation programs, and petroleum storage and remediation programs. Mr. Williams joined DEQ in 2008 as the Waste Enforcement Manager. He has a B.S. in Environmental Health from East Tennessee State University. He obtained a J.D., summa cum laude, from the Appalachian School of Law and served as a Summer Law Clerk for the U.S. EPA's Office of Enforcement and Compliance Assurance. He is licensed to practice law in Virginia and Tennessee.
