The common law maxim of “once a highway, always a highway” applies only until a road is vacated or abandoned in one of the modes permitted by law. The interest available upon termination depends on the interest acquired, which has varied from time to time throughout the history of the Commonwealth. This presentation will summarize methods for creating public roads, the interest acquired, and the procedures for terminating the public interest and vesting title in private ownership.
