LEO: Fees - Collections  LE Op. 835

Fees - Collections.

It is improper for an attorney who, as a corporate employee, represents

his corporation in collection matters to divide with the company that

portion of the collection designated as attorney fees pursuant to an

installment contract. All that is collected as fees is properly the

property of the attorney and may not be returned to the corporation unless

the return of the fee is reimbursement to the corporate employer for the

actual cost of legal services provided by the attorney and billed by the

attorney. [ DR:3-102(A); LE Op. 480]
