LEO: Conflict of Interest — Litigation Adverse LE Op. 785

Conflict of Interest — Litigation Adverse to Former Client.

    May 16, 1986

An attorney was associated with a law firm at a time when the firm defended a corporation in a personal injury/products liability claim. Said attorney was not involved in the firm's representation of the case. The attorney has now been requested to represent the interests of the plaintiff in the earlier case in an appeal which, in part, deals with the effect of subsequent litigation involving plaintiff's release of the corporation. The committee is of the view that since the present litigation is not adverse to the attorney's former firm's representation, it is not improper for the attorney to represent the plaintiff.
