LEO: Misrepresentation - Collection Letter  LE Op. 732

Misrepresentation - Collection Letter.

October 21, 1985

It is improper for an attorney to utilize language in a collection letter

which states that personal property will be levied upon and sold when in

fact a claim has not been initiated and a judgment has not been rendered.

Such language amounts to a misrepresentation which reflects adversely on

the lawyer's fitness to practice law. [ DR:1-102(A)(4)]
