Conflict of Interest - Attorney as Witness - Withdrawal - Attorney's

Fees.

When an attorney has to testify as to the nature and extent of legal fees

for services rendered to a client in an action in which the finder of fact

has the right to award legal fees and when such fees amount to a

substantial portion of the sum sought on behalf of the client, it is not

improper for the attorney to continue to represent the client following

the attorney's testimony as to the value of the legal services rendered to

the client. [See: DR:5-101(B)(2)]
