Conflict of Interest - Representation Against Former Client.

December 19, 1984

It is not improper for an attorney to initiate an action against his

former client alleging negligent causation of injury to his former

client's grandson, the current client, when appropriate disclosure has

been made to both the former client and to the adult parents of the

current client, and when consent has been given to the representation in

both instances. [ DR:4-101(B)(3), DR:5-105(D), LE Op. 441]
