LEO: Divorce Conflict of Interest LE Op. 569

Divorce Conflict of Interest.

April 20, 1984

It would not be improper for an attorney to represent a husband in either a contested or uncontested divorce when he previously represented husband and wife in the purchase of their home which was taken as tenants by the entirety, so long as the attorney had not acquired confidences and/or secrets in the prior real estate transaction which would, or reasonably could, affect either of the parties in a suit for divorce.
